Online Procedure of Trademark Registration

The step-by-step legal journey from application to final certification.

Search & Class Selection Step 1

Application Filing Step 2 (Use ™)

Supporting documents are attached and the TM-A form is e-filed. You will immediately obtain the acknowledgment receipt and can start using the ™ symbol.

Govt. Examination Step 3

The Registrar reviews the application. If they find similarities with existing brands, they may issue an examination report (objection) which requires a legal reply.

Journal Publication & Opposition Step 4

If accepted, it's published in the Trademark Journal. Third parties have 4 months to oppose it. If opposed, a counter-statement must be filed followed by a hearing.

Issuance of Certificate Step 5 (Use ®)

If there is no opposition (or opposition is cleared), the Registrar issues the final Registration Certificate. You can now proudly use the ® sign beside your brand!

Frequently Asked Questions

When can I start using the ™ and ® symbols?
You can use the ™ (Trademark) symbol immediately after your application is filed and you receive an application number. You can only use the ® (Registered) symbol once your trademark is officially registered and the certificate is issued.
How long is a trademark valid in India?
A registered trademark is valid for 10 years from the date of filing the application. It can be renewed indefinitely for successive periods of 10 years by filing a renewal application.
What is a Trademark Class?
Trademarks are categorized into 45 different classes based on the nature of goods and services (Classes 1-34 for Goods, Classes 35-45 for Services). You must file your trademark in the specific class that applies to your business.
Can my trademark application be rejected?
